Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your access to and use of eCommos.ai (the "Service"), operated by eCommos ("we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
2. The Service
eCommos is a platform that helps Shopify merchants generate custom Shopify apps for their stores using AI. We do not act as the vendor of those apps. Apps generated by the Service are deployed into the merchant's own Shopify Partner organization and are owned by the merchant.
3. Account registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and authorized to bind any business you represent.
4. Shopify Partner authorization
To use the Service, you authorize eCommos to act on behalf of your Shopify Partner organization via the Shopify OAuth Device Authorization Grant flow. You may revoke this authorization at any time through your Shopify Partner Dashboard or by contacting us. Revoking authorization stops new app generation but does not delete apps already deployed into your Partner organization.
5. Ownership of generated apps
Custom apps generated through the Service are created in your Shopify Partner organization and are your property. eCommos retains no ownership of merchant-specific app instances. eCommos retains ownership of the underlying platform, skeleton templates, AI prompts, and infrastructure.
6. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy. In summary, you must not use the Service to generate apps that violate Shopify's terms, infringe third-party rights, harm consumers, or process data in violation of applicable law.
7. Fees and payment
During the closed alpha, the Service is provided free of charge to invited pilot merchants. Production pricing combines an infrastructure subscription, generation costs (token-based), and marketplace revenue split, and will be finalized before public beta launch.
8. Data + privacy
Our collection and use of personal data is described in our Privacy Policy. For EU merchants, our Data Processing Addendum applies and supplements these Terms.
9. Service availability
During the alpha period, the Service is provided on a best-effort basis without an SLA. Production tiers will include defined uptime targets at general availability.
10. Termination
Either party may terminate this agreement at any time. On termination, your access to the Service is removed; apps already deployed into your Shopify Partner organization remain yours and continue to function within Shopify's infrastructure.
11. Disclaimers + limitation of liability
The Service is provided "as is" during the alpha period. eCommos disclaims all implied warranties to the extent permitted by law. To the maximum extent permitted by applicable law, eCommos's aggregate liability is limited to the fees you have paid in the 12 months preceding the claim, or USD 100 if greater.
12. Changes
We may update these Terms; material changes will be communicated via email and a notice in the Service. Continued use after changes take effect constitutes acceptance.
